By operating the software included in this package you agree to the following terms. If you do not agree to these terms, you are not permitted to install, use, or modify the robot system purchased. If you reject these terms within fourteen (14) days of your purchase, you may contact Nanite Systems (hereafter "the company") at support@nanite-systems.com to inquire about a full refund of the purchase price of the platform.
Customization. You are allowed to modify or replace the housing of your robot's ARES main control unit (hereafter, main controller) at your leisure. In the event of damage or loss, redelivery may be obtained at no charge.
Reverse engineering and piracy. The company makes every effort to provide a customizable, extensible, and well-documented platform for creative users and developers to enjoy. However, with the exception of certain modules that have been explicitly provided under the ASCL-ii and ASCL-iii software licenses (as described here), the ARES operating system itself is not open source and is not meant to be used on hardware other than the ARES HUD object distributed by Nanite Systems. By using ARES, you agree to not exploit undocumented internal functions, to not build any item that runs the ARES operating system with the intention of selling it unlicensed, and to not collect or distribute any instrument or instructions to enable others to do so, other than the information made available via our official developer information portal at develop.nanite-systems.com.
Software modification. You are permitted to extend, modify, and replace the software on your ARES device for your own personal use, as well as to load any user applications onto the device for any reason. You agree not to hold the company responsible for any direct, indirect, consequential or special damages resulting from the use of unfinished ("pre-release") or third-party software.
Limited warranty. The company agrees to provide service, upgrades, and replacement parts for your robot for a period not less than 10 years after its date of purchase. This service does not cover damage resulting from misuse of the device, unlicensed maintenance, or Force Majeure.
Limitations of liability. You agree not to hold the company responsible for any direct, indirect, consequential or special damages resulting from misuse of the device. In particular, please note the risk to epileptic persons, described below.
ARES and accessories (including but not limited to main controllers, batteries, and ornamental lighting elements) contain elements and special effects that produce sudden bursts of light. These effects are not limited to your own screen. Bystanders may be affected by flashes produced by NS products, including sparks, teleport effects, and electromagnetic pulse (EMP) defensive weapons. It is possible to cause harm simply by teleporting near to a person with photosensitive epilepsy.
Although we have taken steps to allow the disabling of these effects through onboard settings, bugs in Second Life mean that these settings (and other changes) can sometimes be rolled back or lost. Additionally, it is always possible to inadvertently expose a photosensitive friend to a third party.
If you have ever experienced a light-induced seizure or have a family history of epilepsy, we urge you not to buy ARES, or any other robot system. If you are aware of a friend or loved one with epilepsy, only removing your ARES attachments entirely in their presence can guarantee that ARES does not put them at risk.
Despite the effort we have put into allowing customers to minimize the risks to their loved ones, it is our opinion that our products are not safe for photosensitive individuals. By knowingly using Nanite Systems products near people with epilepsy, you are responsible for any consequences of this risky behavior.
Unfortunately, there is always a risk of encountering harmful or abusive content in Second Life, and on the Internet in general. Virtually all 3D programs are capable of accidentally inducing flashing effects due to a phenomenon known as z-fighting. As of this writing there are several known instances of journalists with epilepsy being deliberately targeted on social media by trolls using flashing images. Until a technology for preventing seizure induction becomes widely available and reliable, the very act of participating in multi-user online interactions carries with it an elevated level of risk.
License limitations. You understand that your license to use the hardware may be revoked at any time by the company due to breach of contract.
Alterations. The company reserves the right to change this agreement at any time with suitable notice to the user.
Term and termination. This agreement comes into effect once you install, use, or modify your unit. The company reserves the right to terminate the agreement at any time without notice at its sole discretion.
